The Supply Chain Due Diligence Act (LkSG) requires large German companies to uphold human rights and environmental standards in their supply chains. It mandates a risk assessment, preventive and remedial measures, and regular reporting. The goal is to prevent human rights violations and environmental damage throughout the entire supply chain. Sanctions may be imposed for noncompliance.

The following German companies must comply with the LkSG:
2023: >3,000 employees
2024: >1,000 employees

While the German Supply Chain Due Diligence Act (LkSG) focuses primarily on human rights and environmental risks along the supply chain, the European Corporate Sustainability Due Diligence Directive (CSDDD) imposes additional requirements on companies, such as taking climate change into account and providing broader coverage of the supply chain.

The following European companies must comply with CSDDD:
2027: >5,000 employees; revenue >1,500 million euros
2028: >3,000 employees; revenue >€900 million
2029: >1,000 employees; revenue >€450 million
Non-EU companies with >€450 million in revenue in the EU
Approx. 1,500 companies in Germany
Approx. 5,300 companies in the EU
Additional companies outside the EU are affected
The same due diligence obligations as in the LkSG, but with human rights and environmental aspects expanded to include issues such as children’s rights, biodiversity, and the law of the sea
. An annually updated climate target plan is also required.

What do the latest developments regarding the LkSG and CSDDD mean for my company?

On July 5, 2024, the federal government published a package of measures to boost growth (“Growth Initiative—New Economic Momentum for Germany”) as part of the 2025 draft budget. Part of the package involves simplifications to the Supply Chain Due Diligence Act (LkSG). These include:

Implementation of the CSDDD regulations with minimal bureaucracy through an amendment to the LkSG and a delayed introduction of civil liability
The CSDDD obligations are not expected to become legally binding for the following companies until a later date:
2027: >5,000 employees worldwide, >€1,500 million in revenue
2028: >3,000 employees worldwide, >€900 million in revenue
2029: >1,000 employees worldwide, >€450 million in revenue
Companies that publish a sustainability report in accordance with the CSRD (Directive (EU) 2022/2464) are exempt from additional LkSG reporting requirements. In addition, sanctions for violations of the LkSG reporting requirement are to be waived until the CSRD is implemented.
The federal government plans to introduce mandatory standards for data collection from SMEs in supply chains in order to reduce the burden on them as data providers.
